How to register your comment

The first thing you need to do is file a notice of intent to participate. They don’t want this process to be easy, so we are going to do as much as we can for you.

We know this process is not simple. As much as we wish it were, you have to follow the steps for your comments to be registered.

Step 1: Prepare your documents

To register a notice of intent to participate in the merger conversations, you will need:

Step 2: generate the parties of record list

Option 1: The official Process

Go to the STB.gov -> Proceedings and Actions -> Dockets (including Service Lists) – or click this link.

To generate the service list, add the docket information FD 36873, press search

When the results appear, it should show you the FD_36873 with the docket name, select “generate service list”

You will need to copy all of the email addresses listed as party of record.

Option 2: Use the list we keep updated daily

We are working to keep this list updated daily.

Why didn’t we show this first?

We are trying to keep everything to standard. Any miss in the process and your comments can be disregarded by the Surface Transportation Board.

Step 3: Email the parties of record your notice of intent to participate

take the list of emails, and send an email to all parties of record with your notice of intent to participate. Document the date and time you sent the email.

  • Email Subject: STB Docket FD 36873 – Notice of Intent to Participate
  • Email body: Please see the official notice of intent to participate in the above-mentioned proceedings. 

Step 4: File on the surface transportation board website

Go to the STB’s formal filing by clicking this link

Fill out the form (example in the screenshot) – attach the notice of intent that you emailed, along with the certificate of service, which should now include the time and date you served the parties of record.

You will get emails about the docket

Most days, this is manageable. There will be more emails when the merger application is refiled.

If this is an issue, set up a rule to send the docket emails to a folder.
